US K1 Visa allows you as an American to take your Thai fiancé/fiancée to the United States with the intention to get married when in the United States.

Requirements:

  1. You must be a US Citizen to petition for the K1 Visa in Thailand;
  2. You must have met your fiancee face to face during the last two years.
  3. You and your fiancee must pass a criminal record check for the K1 Visa Thailand;
  4. Your Thai fiancee must pass a medical exam for the K1 Visa;
  5. You must meet the financial requirements for the K1 Visa in Thailand;
  6. You and your Thai fiancee must be free to marry to obtain a K-1 Visa Thailand.
  7. You must have the inention to marry your fiancee within 90 days of arriving in the United States

Starting your US K3 Visa application process in Thailand for your Thai spouse? When a US citizen marries the Thai fiancée in the USA or in Thailand, the Thai fiancée goes back to Thailand, the US citizen applies to the Service Center for an I-130 spousal visa petition for his new Thai spouse.

The US citizen will be notified by mail of the notice of receipt from the service center for the I-130 petition of the Thai Spouse. The US citizen files an I-129F petition to the USCIS Dallas Lockbox for a K3 visa application from Thailand. The USCIS forwards an approved I-129F to the State Department, which forwards it to the embassy.

Basic Eligibility Requirements:

  1. The sponsoring husband or wife must be a U.S. citizen, and the beneficiary must be their spouse;
  2. There must be a pending immigration petition naming the foreign spouse as a beneficiary on file with the USCIS;
  3. The marriage between the U.S. citizen and foreign spouse must be valid, meaning that they have met all requirements to have a valid marriage in the country/jurisdiction where they married, and were not subject to any impediment (such as a non-terminated prior marriage) to their ability to marry at that time.

The CR-1 (Conditional Resident) visa allows Thai applicants to receive conditional permanent residence upon arrival in the US. Recipients of the CR-1 are able to work immediately upon arrival in the US. Conditional Residents usually receive their green card in the mail 2 - 3 months after arrival. Permanent resident status is considered conditional, because the immigrant must prove that they did not get married merely to circumvent the immigration laws of the United States.

The conditional resident and the US citizen spouse must apply together to remove the conditional status of permanent residence. It is advisable to apply 90 days before the end of the spouse’s second year as a conditional resident. If the application to remove conditional status is not filed in time, the immigrant spouse could lose her conditional resident status and be subject to removal from the country.

An IR-1 (Immediate Relative) visa is for a Thai spouse that has been married to a US citizen for two (2) or more years. The IR-1 is basically the same as the CR-1 except that upon arrival in the United States the holder of an IR-1 visa is an unconditional permanent resident with the immediate right to work. There is no conditional period of residence and the IR-1 holder does not need to file to have his/her residence made permanent. IR-1 holders usually receive their green card in the mail 2 - 3 months after arrival.

The K-2 nonimmigrant visa allows the child of a K-1 Thai fiancé visa holder to enter into the U.S. and await the availability of an immigrant visa. This is one of the benefits of the K1 visa- it allows derivative beneficiary.

The K4 visa is nonimmigrant visa which allows the children of K-3 Thai spouse visa holder to enter into the U. S. and await the availability of an immigrant visa.

Requirements:

  1. The child must be under 21 years old at the time the visa will be issued at the US embassy in Thailand.
  2. The child must be unmarried

K2 Visa Benefits:

  1. The child doesn’t need a separate I-129F application from Thailand
  2. The visa for the child will be approved at the same time as the Thai fiancée at the US Embassy in Bangkok
  3. Reside in the U. S. with the parent while waiting for the marriage of his K-1 parent.
  4. The child is allowed to study in the U.S. on K-2 visa and/or apply for Employment Authorization I-765.
  5. Cheaper and faster processing is needed compared to I-130 petition of Alien Relative.

K4 Visa Benefits:

  1. The child doesn’t need a separate I-129F application.
  2. The visa for the child will be approved at the same time as the Thai Spouse at the US Embassy in Bangkok
  3. The child will be allowed to live in the US while waiting for the immigrant visa processing
  4. Travel outside of the U.S. on short trips and return.
  5. The child is allowed to study and/or apply for Employment Authorization I-765
